A Quick Guide to Understanding RICO

A Quick Guide to Understanding RICO

We hear about all kinds of crimes on a daily basis. RICO refers to the Racketeer Influenced and Corrupt Organizations Act. What are some examples of RICO crimes? RICO crimes include:

  • Homicide
  • Extortion
  • Kidnapping
  • Robbery
  • Arson

RICO laws were originally established in attempt to combat the Mafia. It includes charges that can be prosecuted in state or federal court. Both of these jurisdictions allow for extended criminal penalties for someone who has been convicted of a RICO violation. There may also be civil causes of action brought under RICO for acts performed while part of an ongoing criminal organization.

History of RICO

RICO was first enacted through the Organized Crime Control Act in 1970. Although the application is mostly geared towards prosecuting those engaged in organized crime, it has become more widespread in actual use for law enforcement to investigate and prosecute individuals that were never initially contemplated under the initial statute.

Under federal RICO charges, a person who is a member of an enterprise that has committed two of any 25 crimes within a 10-year period can be charged with racketeering. A person found guilty of racketeering could be facing a maximum sentence of 20 years in prison.

The person who has been convicted of this type of crime also has to forfeit all properties and interest in any business that was gained through the violation of a RICO act. The government could also seek pre-trial restraining orders or injunctions to seize a defendant’s assets and prevent further transfer of any forfeitable property.

The Complexity of RICO

RICO is an extremely complex law that requires that the government prosecute you seriously, and they must overcome many challenges in order to convict you. It can be a mistake to assume that you can handle your RICO defense on your own because of the complex nature of all of these cases.

There are many reasons for which the federal government can pursue charges for RICO violations. If you suspect that you’re being investigated or if you have already been accused, taking control of the situation by hiring an attorney is an important first step.

Since it is against federal law to participate in or make money from any type of racketeering, you could be facing serious consequences if charged with racketeering. Some of the most commonly targeted activity by RICO involves acquiring or maintaining an interest in any enterprise through racketeering, using money from racketeering activity to establish or operate a business, or conducting the illegal or legal affairs of a business or organization through racketeering activity.

The government has to target a group’s instances of criminal wrongdoing in order to pursue charges. They must demonstrate that a pattern existed in order to do this. One of the best things that you can do if you have been accused of violating RICO laws is to contact an experienced drug defense attorney in Florida.

When you’re accused of breaking the law with anything to do with relating to drugs, this is a significant charge and can impact your future substantially. You may be looking at fines, jail time, or other negative consequences. Being accused of breaking the law in this matter requires the insight of an experienced drug defense lawyer. Do not hesitate to get help from someone who is knowledgeable and committed to your case.
